Indian patent act 1970..lays down



1) Grant of revocation of patents
Patent may be granted to an invention subject to the provisions of the act. There is also a provision for grant of patents of addition to the patentee(for improvement)
2) Items not patentable:
Inventions against the public interest, method of agriculture or horticulture, a mathematical or a business method, or a computer programme, algorithm etc.


3.) product patent:
Previously it was process patent which allowed to manufacture the same or similar product by a process different from the patented one. This is not allowed because of the adoption of the product patent.
4) Patent period-20 years from the date of application


5) rights and obligations of patentee:
Patentee has the exclusive right to use, make, sell or import the patented process/product. Normally prevents the third parties from using, making, selling or importing the patented product.


Trade mark act 1999


Objectives:
The registration and better protection of trade marks for goods and services.
The prevention of the use of fraudulent marks.
The central Govt appoints a Controller general of patents, Designs and Trade marks who works as a registrar for the purpose of trade marks
