The management of hazardous waste, the collection, treatment and disposal of waste which, when improperly handled, can cause considerable damage to human health and safety or the environment. Hazardous waste can take the form of contained solids, liquids, sludges or gases, and are generated primarily by chemical production, manufacturing and other industrial activities. They may cause damage during improper storage, transportation, treatment or disposal operations. Improper storage or disposal of hazardous wastes often contaminates surface and groundwater supplies. People living in homes built near old and abandoned waste disposal sites may be in a particularly vulnerable position. In an effort to remedy existing problems and prevent future damage from hazardous wastes, governments closely regulate the practice of hazardous waste management.
Hazardous waste is waste that poses substantial or potential threats to public health or the environment. In the United States, the treatment, storage and disposal of hazardous wastes are regulated by the Resource Conservation and Recovery Act (RCRA). Hazardous wastes are defined under RCRA at 40 CFR 261 where they are divided into two main categories: characteristic wastes and wastes listed. Hazardous wastes, generated mainly by industrial processes, are regulated under the Hazardous Waste (Transboundary Movement and Management) Rules, 2016, which have replaced the previous Hazardous Waste (Handling, Management and Transboundary Movement) Regulations, 2008
The guidelines have established specific guidelines for the identification of hazardous wastes, their recycling, transport and disposal. The Board is empowered to grant Authorization to all persons involved in the generation, collection, treatment, storage, transportation, use / processing or disposal of hazardous wastes in the State.
The Board has a limited role in controlling the import and export of hazardous wastes through ports located in the State. The nodal authority in this case is the Ministry of Environment and Forests, GoI (MoEF). All importers and exporters of hazardous wastes listed in Parts A, B and C of Schedule III of the Standards must request and obtain formal authorization from the MOEF prior to undertaking such activity. A copy of the request must be presented to the Board and in case the Board has any opinion or objection, it is communicated to the MOEF.
