In the United States, a design patent is a form of legal protection granted to the ornamental design of a functional article. Design patents are a type of industrial design right. Ornamental jewelry designs, furniture, beverage containers and computer icons are examples of objects that are covered by design patents.
A similar concept, a registered design can be obtained in other countries. In Kenya, Japan, South Korea and Hungary, industrial designs are registered after an official search for novelties. In the European Community countries, it is only necessary to pay an official fee and meet other formal registration requirements (eg EUIPO design, Germany, France, Spain). For WIPO Member States, coverage is obtained through registration in WIPO and examination by Member States designated in accordance with the Geneva Act of the Hague Agreement.
