The Factories Act 1948 (Act No. 63 of 1948) as modified by the Factories (Amendment) Act of 1987 (Act 20 of 1987) serves to help formulate national policies in India on occupational safety and health in factories and docks In India. It addresses a number of issues related to safety, health, efficiency and well-being of people in the workplace.
The Law is administered by the Ministry of Labour and Employment in India through its General Directorate for the Advisory Service of Factories and Labour Institutes (DGFASLI) and by the state governments through its factory inspectors. DGFASLI advises central and state governments on the administration of the Factories Act and the coordination of factory inspection services in the States.
The Law is applicable to any factory in which ten or more workers work, or were working on any day of the previous twelve months, and in any part of which a manufacturing process is carried out with the help of power, or are ordinarily carried out, or where twenty or more workers work, or were working on any day of the preceding twelve months, and in any part of which a manufacturing process is carried out without the aid of energy, or normally is carried out; but this does not include a mine, or a mobile unit belonging to the union's armed forces, a railroad hut or a hotel, restaurant or food venue.
